    AGREEMENT TO TERMS

    These Terms of Use constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”), and Gospel Musicians LLC (“Company,” “we,” “us,” or “our”), concerning your access to and use of GospelMusicians.com, including any related media form, media channel, mobile website, or mobile application (collectively, the “Site”).

    By accessing or using the Site, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use. If you do not agree with all of these Terms, you are expressly prohibited from using the Site and must discontinue use immediately.

    Supplemental terms or documents that may be posted on the Site from time to time are hereby expressly incorporated by reference. We reserve the right to modify these Terms at any time. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.


    ELIGIBILITY & JURISDICTION

    The Site is not intended for use by any person or entity in any jurisdiction where such use would violate applicable laws or regulations. Users accessing the Site from outside the United States do so at their own initiative and are responsible for compliance with local laws.


    INTELLECTUAL PROPERTY RIGHTS

    Unless otherwise stated, the Site and all content, including source code, databases, software, designs, audio, video, text, graphics, and trademarks (collectively, the “Content” and “Marks”), are owned or licensed by Gospel Musicians LLC and are protected by U.S. and international intellectual property laws.

    You are granted a limited, non-exclusive, non-transferable license to access and use the Site for personal, non-commercial purposes only. No part of the Site or its Content may be copied, reproduced, sold, licensed, or exploited without our prior written consent.


    USER REPRESENTATIONS

    By using the Site, you represent and warrant that:

    1. You have legal capacity and agree to comply with these Terms

    2. You are not a minor in your jurisdiction

    3. You will not use automated or non-human means to access the Site

    4. You will not use the Site for illegal or unauthorized purposes

    5. Your use will comply with all applicable laws

    We reserve the right to suspend or terminate accounts containing false, inaccurate, or incomplete information.


    PRODUCTS

    We make reasonable efforts to display products accurately but do not guarantee descriptions, pricing, or availability. Products are subject to change or discontinuation at any time without notice.


    PURCHASES & PAYMENT

    Accepted payment methods include Visa, Mastercard, American Express, Discover, PayPal, money orders, and wire transfers.

    You agree to provide accurate billing information and authorize us to charge your selected payment method. Prices are subject to change. Sales tax may be applied where required.

    We reserve the right to refuse or cancel any order, limit quantities, or prohibit purchases suspected of resale or fraud.


    CHARGEBACKS & ACCOUNT RESTRICTIONS

    Initiating a chargeback without first contacting us may result in:

    • Revocation of product access

    • Account termination

    • Purchase restrictions

    Unauthorized chargebacks may be treated as a violation of these Terms.


    PROHIBITED ACTIVITIES

    You may not use the Site for unauthorized commercial activities, unlawful purposes, or actions that compromise system integrity or intellectual property.


    SUBMISSIONS

    All feedback, suggestions, or ideas submitted to us become our exclusive property and may be used without compensation or attribution.


    SITE MANAGEMENT

    We reserve the right to monitor the Site, restrict access, remove content, or take legal action for violations of these Terms.


    TERMINATION

    We may terminate or suspend your access at any time, without notice, for any violation of these Terms or applicable law. Re-registration after termination is prohibited.


    MODIFICATIONS & INTERRUPTIONS

    We reserve the right to modify or discontinue the Site at any time without liability. We are not responsible for service interruptions or maintenance downtime.


    GOVERNING LAW

    These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles.


    DISPUTE RESOLUTION

    Binding Arbitration

    Disputes shall be resolved by binding arbitration under the rules of the American Arbitration Association (AAA) in Orange County, Florida, except for excluded claims listed below.

    Exceptions

    Arbitration does not apply to:

    • Intellectual property disputes

    • Theft, piracy, or unauthorized use

    • Requests for injunctive relief

    Class actions are prohibited.


    DISCLAIMER

    THE SITE AND SOFTWARE ARE PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.


    LIMITATION OF LIABILITY

    Our liability shall not exceed the amount paid by you, if any. We are not liable for indirect, incidental, or consequential damages.


    INDEMNIFICATION

    You agree to indemnify and hold harmless Gospel Musicians LLC from claims arising from your use of the Site or violation of these Terms.


    USER DATA

    We perform routine backups, but you are solely responsible for your data. We are not liable for data loss or corruption.


    ELECTRONIC COMMUNICATIONS

    Visiting the Site, sending emails, completing forms, and opting in to SMS communications constitute electronic communications. You consent to receive communications electronically.


    SMS MARKETING & TEXT MESSAGE COMMUNICATIONS

    By providing your mobile number and opting in, you consent to receive recurring SMS/MMS messages from Gospel Musicians LLC, including promotional, transactional, and account messages.

    • Message frequency varies (typically 1–8 per month)

    • Message & data rates may apply

    • Consent is not a condition of purchase

    You must be at least 18 years old and the authorized user of the phone number. Carriers are not responsible for delayed or undelivered messages. Your information is governed by our Privacy Policy.

    MISCELLANEOUS

    These Terms constitute the entire agreement. If any provision is deemed unenforceable, the remainder remains valid.


    END USER LICENSE AGREEMENT (EULA)

    (Cleaned and retained exactly as intended, no material changes)

    The SOFTWARE is licensed, not sold. One license allows use on two machines by a single user. Redistribution, reverse engineering, or unauthorized copying is prohibited.

    The SOFTWARE is provided “AS IS”, without warranty. Liability is limited to the maximum extent permitted by law.
